Terms and Conditions
1. PURPOSE
The General Terms and Conditions apply exclusively to the online sale of products available on the website www.avelaineleroy.com, which is open to public access.
2. SCOPE OF APPLICATION
These General Terms and Conditions of Sale (GTC) exclusively govern online sales contracts for Avelaine Leroy products concluded with buyers who are consumers, and constitute, with the online order, the only contractual documents binding on the parties.
All other documents such as prospectuses, catalogues or photographs of products, which are only indicative, are expressly excluded.
The General Terms and Conditions apply exclusively to sales of products delivered to consumers established in France or internationally.
The applicable T&Cs, as well as all contractual information appearing on the site, are written solely in French.
3. AVAILABILITY OF THE GTC
These General Conditions of Sale are made available to the consumer on the website www.avelaineleroy.com where they can be consulted freely at any time.
The consumer acknowledges, by ticking the box provided for this purpose during the ordering process, having read these General Terms and Conditions and having accepted them without reservation.
Validation of the order by its confirmation constitutes full and complete acceptance of these General Conditions of Sale, in force on the day of the order. These latter prevail over any other document, unless otherwise agreed in writing.
Their conservation and reproduction are ensured by the professional seller, in accordance with article 1127-2 of the Civil Code.
4. COLLECTION AND USE OF PERSONAL DATA
As part of managing your orders and improving our service, we collect certain personal data when you make a purchase on our site. This includes information such as your name, email address, delivery address, and order details.

5. PRODUCTS
5.1 Characteristics
The products for sale presented in the catalog published on the site are each the subject of a description mentioning their essential characteristics within the meaning of article L. 111-1 of the consumer code.
The photographs illustrating the products do not constitute contractual documents.
Original artwork comes with a certificate of authenticity.
5.2 Use of the products
The site offers for sale original works of art by the artist Avelaine Leroy, reproductions of her works of art as well as products derived from her artistic creations.
5.3 Compliance
The artist guarantees the authenticity of the original works and the conformity of the reproductions.
6. SALE PRICE
6.1 Displayed price
The sales prices, in accordance with Article L. 112-1 of the Consumer Code, are indicated, for each of the products appearing in the electronic catalogue, in euros including all taxes, excluding delivery and transport costs mentioned before validation of the order and invoiced in addition.
The total amount due by the consumer is indicated on the order confirmation page.
The sale price of the product is that in effect on the day of the order.
The sale price of the products does not include shipping costs charged in addition to the price.
In the event of a price promotion, the professional seller undertakes to apply the promotional price to any order placed during the period of advertising for the promotion.
6.2 Modification
The professional seller reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in effect on the day of the order.
6.3 Additional charges
Additional transport, delivery or postage costs (to which must be added any other costs incurred by the seller), which the consumer may have been aware of before ordering, are set out on the order form.
6.4 Promotional prices and discounts
When the seller displays a promotional price or a price reduction, this is calculated on the basis of the lowest price charged during the thirty (30) days preceding the start of the promotion, in accordance with the provisions of Article L.112-1-1 of the Consumer Code.
This rule applies to any offer publicly visible on the site, including in particular sales campaigns, temporary discounts, flash sales or commercial operations displaying a crossed-out price or a percentage reduction.
6.5 – Promotional offers and discount codes
Promotional codes, including those resulting from collaborations or affiliation operations, cannot be combined with each other or with other current promotions, unless expressly stated otherwise.
The seller reserves the right to set a minimum purchase amount for their application (for example, €100 including VAT), as well as to exclude them from certain products or commercial periods.
In the event of improper use, the seller may cancel the order or deactivate the code concerned, without compensation.
7. ORDER
The consumer can place an order directly on the website www.avelaineleroy.com
The ordering process includes the following steps:
- • Selection of the product(s)
- • Adding to cart
- • Cart validation
- • Enter contact details and choose delivery method
- • Secure payment
Before confirming the order, the consumer can check the details of their basket and its total price, and correct any errors.
The order is deemed final after validation of payment.
A confirmation email is automatically sent to the address provided by the customer.
Validation of the order implies full acceptance of these T&Cs.
7.1 Limitation of abnormal or suspicious orders
The seller reserves the right to refuse or cancel any order that is abnormal in quantity or frequency, or that suggests professional, fraudulent or unauthorized use.
Such a decision may be taken without notice or compensation, provided that the consumer's behavior does not correspond to reasonable use expected of an end consumer.
8. PAYMENT
8.1 Due Date
The price is due in full after order confirmation. Payment is made immediately upon ordering by credit card or PayPal.
8.1 bis Payment via Klarna
To offer more flexibility, the Customer can pay for their purchases via Klarna .
- • Instant payment : one-time payment via Klarna.
- • Deferred or installment payment : depending on the amount and country of residence, Klarna may offer payment in 3 or 4 installments (often without fees) or a payment deferral.
- • Terms :
- o Eligibility for split payment is determined directly by Klarna at the time of ordering.
- o HOLIAE has no control over this decision and cannot be held responsible for a refusal of funding.
- o The Customer must accept Klarna's General Conditions , available on www.klarna.com .
- • Contractual relationship : Any credit agreement is concluded exclusively between the Customer and Klarna.
The order is considered final only after validation of payment by Klarna.
8.2 Payment security
The site is equipped with an online payment security system that allows the consumer to encrypt the transmission of their banking data via the secure payment platform's electronic payment server. At no time will the consumer's banking data pass through the seller's computer system.
8.3 Payment conditions/incidents
In the event of refusal of payment authorization by the banking establishment or of a payment incident, the seller reserves the right to suspend the order or cancel it.
Any fraud or attempted fraud may be subject to legal action.
9. DELIVERY
Delivery means the transfer to the consumer of physical possession of the goods.
9.1 Delivery costs
Delivery with signature via Colissimo, Chronopost or Mondial Relay is offered in several options depending on the destination chosen for orders of original works:
- • Metropolitan France and Monaco : Free standard delivery (2 to 4 business days) or to a collection point (3 to 5 business days). Express delivery available in 1 to 2 business days (€10).
- • European Union : standard delivery in 2 to 8 working days (€5) or express delivery in 1 to 3 working days (€15).
- • Switzerland : express delivery in 1 to 3 working days (30 CHF).
- • Overseas Departments (Réunion, Mayotte, Guadeloupe, Martinique, Guyana) : express delivery in 3 to 5 working days (€69).
- • Overseas Territories (Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon, New Caledonia, French Polynesia, Wallis-et-Futuna) : express delivery in 5 to 10 working days (€119).
- • United States : Express delivery in 1 to 3 business days ($40).
The times indicated are given as an estimate and may vary depending on the carrier or exceptional circumstances (customs, public holidays, etc.).
Regarding the purchase of products delivered by our service providers, the delivery costs are indicated in the basket at the time of purchase.
9.2 Shipping time
Under normal conditions, orders are prepared within an estimated period of 2 to 3 working days from their validation, excluding weekends and public holidays, and subject to product availability.
These lead times are indicative and may vary depending on order volume, period or exceptional circumstances.
9.3 Delivery time
Once shipped, the order is handed over to La Poste (Colissimo, Chronopost) or Mondial Relay, at the Customer's choice.
Delivery time is estimated between 2 and 6 working days for mainland France or Belgium.
Delivery times abroad vary depending on the destination, customs and local carrier.
These delivery times are given for information purposes only. The seller cannot be held responsible for any extension beyond its control (carrier delay, force majeure, logistical blockage, etc.).
The consumer agrees to facilitate the delivery of the package (visible name, access information, telephone, etc.).
9.4 Delay in delivery
In the event of a clear delay, the consumer is invited to contact customer service so that an investigation can be opened with the carrier.
In accordance with Article L.216-2 of the Consumer Code, if delivery has not taken place within a maximum period of thirty (30) calendar days from the order, the consumer may request cancellation of the contract and full reimbursement of the sums paid.
In accordance with Article L.216-2 of the Consumer Code, if delivery has not taken place within thirty (30) calendar days from the order, the Customer may demand termination of the contract and obtain full reimbursement of the sums paid.
9.5 Place of delivery
The products are delivered to the address indicated by the consumer on the order form.
9.6 Receipt of the package and anomaly
It is the consumer's responsibility to check the apparent condition of the package and products upon delivery. The consumer is required to check the condition of the package upon receipt.
Any anomaly (damaged or opened package, missing product, reference error, etc.) must be reported within a maximum of 48 hours by email to our customer service at the following address: avelaineleroy@gmail.com, with supporting photos.
After this period, we cannot guarantee the processing of the file with the carrier or hold it liable. In the absence of a complaint within this period, the delivery will be deemed to be compliant, without prejudice to the right to legal guarantee provided for in Article 10.
9.7 Delivery outside the EU
For any delivery outside the European Union, the consumer is solely responsible for the payment of customs duties, local taxes or other import charges that may be payable.
10. AVAILABILITY OF PRODUCTS
Products are offered and delivered within the limits of available stocks.
In the event of unavailability of the product ordered, the seller shall immediately inform the consumer and may offer them a product of equivalent quality and price or, failing that, a voucher for the amount of the order which can be used for any future order.
In the event of disagreement by the consumer, the seller will reimburse the sums paid within 30 working days.
Apart from the reimbursement of the price of the unavailable product, the seller is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to him.
11. CONFORMITY OF PRODUCTS AND TRANSFER OF OWNERSHIP
11.1 Product conformity
The artist guarantees the authenticity of the original works and the conformity of the reproductions.
In the event of proven non-conformity, the seller undertakes, as the case may be, to repair or replace the product at no additional cost to the consumer, within a reasonable time.
11.2 Transfer of ownership
Ownership of the products is transferred to the consumer only after full and effective payment of the price, including the principal and any additional costs.
In accordance with the provisions of Article L.216-4 of the Consumer Code, the risks associated with the products (loss, theft, deterioration) are transferred to the consumer at the time of delivery of the package to the carrier, or upon direct delivery if this is provided by the seller.
12. RETURN OF PRODUCTS & RIGHT OF WITHDRAWAL
In accordance with Articles L.221-18 et seq. of the Consumer Code, the consumer has a period of fourteen (14) calendar days from receipt of his order to exercise his right of withdrawal, without having to provide reasons or pay penalties, with the exception of return costs, which remain his responsibility.
The right of withdrawal can be exercised:
- • Either by filling out the contact form here.
- • Or by any other written, clear and unambiguous means, in particular by email addressed to: avelaineleroy@gmail.com.
The seller will immediately send an acknowledgment of receipt of the withdrawal on a durable medium (for example, by email).
Products must be returned in their original condition and in their entirety (packaging, accessories, instructions, etc.), allowing them to be resold as new. Any damaged, incomplete, used or opened product cannot be refunded.
In the event of valid exercise of the right of withdrawal, HOLIAE will reimburse all payments received (excluding return costs) via the same means of payment as that used when ordering, within a maximum period of fourteen (14) days from the actual receipt of the returned products.
In accordance with Article L.221-24 of the Consumer Code, the seller reserves the right to defer reimbursement until physical receipt of the package and verification of compliance with the return conditions (unopened, unused, complete product).
No proof of shipment can replace actual receipt of the product.
The seller also reserves the right to refuse any clearly abusive return request, particularly in the event of repeated use of the right of withdrawal for the sole purpose of obtaining a product without obligation.
The right of withdrawal must be exercised in good faith, in compliance with its purpose as provided for by law.
12.1 Partial Return - Exclusion
Reimbursement under the right of withdrawal is conditional upon the complete return of the product.
The seller does not accept any partial returns.
The product must be returned in its entirety, including all original elements and accessories (mask, strap, cable, controller, eye protection, instructions, packaging).
Any incomplete, opened, used or damaged return will be automatically refused and will not give rise to any refund.
13. REFUND POLICY (EXCLUDING RIGHT OF WITHDRAWAL)
Apart from the right of withdrawal provided for in Article 12, the seller applies the following rules for processing refund requests.
The consumer is required to report any request in writing, specifying the order number or the email address associated with the purchase.
Defective or damaged product upon receipt:
Any apparent damage must be reported as soon as possible, ideally within forty-eight (48) hours of receipt.
In accordance with Articles L.217-3 to L.217-7 of the Consumer Code, any lack of conformity may be reported for a period of two (2) years from delivery.
Product not compliant with the order:
In the event of a proven error in the delivered product (incorrect model, missing accessory, etc.), the seller will cover the return costs and will offer, at the consumer's choice, either a return of the compliant product or a full refund.
Undelivered or lost package:
In accordance with Article L.216-2 of the Consumer Code, in the event of non-receipt within a period exceeding thirty (30) calendar days from the order, and after written notification from the consumer, the seller will offer reshipment or a full refund of the order.
The seller cannot, however, be held responsible for a failure to deliver attributable exclusively to the carrier, provided that it has met its shipping obligations within the announced deadlines.
These provisions apply without prejudice to legal guarantees, in particular the guarantee of conformity provided for in Article 10.

14. CONDITION OF RESALE AND RECONDITIONING
Products sold on the site may not be resold or repackaged for commercial or professional purposes without the prior written consent of the artist Avelaine Leroy.
This restriction does not apply to consumers acting in a private capacity, who retain the freedom to resell products acquired for personal use, particularly on platforms between individuals.
Any resale or reconditioning carried out in violation of this clause may be subject to prosecution, in particular for unfair competition or infringement of trademark rights.
15. MODIFICATION OF THE GTC
These T&Cs were updated on September 20, 2025.
The professional seller reserves the right to modify its T&Cs at any time.
In the event of modification of the T&Cs, the applicable T&Cs are those in force on the date of the order, a copy of which dated on that date may be provided to the consumer upon request.
16. GENERAL CLAUSES NULLITY AND INAPPLICATION
The invalidity of a contractual clause does not entail the invalidity of the General Terms and Conditions. The temporary or permanent non-application of one or more clauses of the General Terms and Conditions by the professional seller cannot constitute a waiver on its part of the other clauses of the General Terms and Conditions, which continue to produce their effects.
17. ARCHIVING AND EVIDENCE
The archiving of communications, purchase orders and invoices is carried out on a reliable and durable medium in order to constitute a faithful and durable copy in accordance with Article 1360 of the Civil Code (former C. civ., Art. 1348). These communications, purchase orders and invoices may be produced as proof of the contract. The data recorded by the seller as well as by its payment service providers are authentic between the parties and constitute proof of financial transactions.
18. DISPUTE RESOLUTION
The seller cannot be held liable for damages resulting from improper, inappropriate or contrary use of its products, within the limits provided for by current legislation.
This limitation of liability does not apply in the event of a breach of the seller's legal obligations, in particular in terms of product safety, compliance or personal injury linked to a defect.
The seller cannot be held liable for indirect, immaterial or consequential damages resulting from the use or misuse of the products sold.
In any event, the seller's liability, for all causes combined, cannot exceed the total amount of the order concerned.
This limitation does not apply in the event of gross negligence, wilful misconduct, or in the event of bodily injury caused by a product defect.
In the event of a dispute, the buyer is invited to contact customer service as a priority at the following address: contact@holiae.com, in order to seek an amicable solution.
19. FORCE MAJEURE
The seller cannot be held liable for any failure to fulfill its contractual obligations in the event of the occurrence of an event constituting force majeure, as defined in Article 1218 of the Civil Code.
The following are considered cases of force majeure, without this list being exhaustive: natural disasters, fires, floods, pandemics, epidemics, armed conflicts, acts of terrorism, strikes affecting postal services or means of transport, interruptions to telecommunications networks, administrative or governmental decisions, or any other unforeseeable, irresistible and external event making the execution of the contract impossible.
In the event of force majeure, the performance of the seller's obligations will be suspended for the entire duration of the event, without this giving rise to any right to compensation.
20. NON-WAIVER
The fact that the seller does not avail himself at a given time of any of the clauses of these General Conditions of Sale cannot be interpreted as a waiver of the right to avail himself of them subsequently.
21. PROCESSING OF PERSONAL DATA
Personal data collected on the seller's website is processed in accordance with current regulations and our privacy policy.

Messages are processed within an average of forty-eight (48) business hours, excluding weekends and public holidays.
21.1 – Transfer of data outside the European Union
Some of our technical service providers (hosting, e-commerce platform, email service, analysis tools or social networks) may be located outside the European Union, particularly in the United States.
In this case, the seller ensures that these transfers are covered by appropriate guarantees, such as:
- • standard contractual clauses validated by the European Commission,
- • or an adequacy decision taken by the Commission for the country concerned.
These measures aim to guarantee a level of protection equivalent to that required within the European Union, in accordance with Articles 44 et seq. of Regulation (EU) 2016/679 (GDPR).
22. CUSTOMER EVALUATION AND REVIEWS
After their purchase, customers may be asked by email to leave a review of their experience and the products received. The seller only publishes verified reviews, collected after an actual purchase or authenticated interaction. In accordance with the recommendations of the DGCCRF, no reviews are modified, deleted, or purchased. Reviews deemed fraudulent or non-compliant may be moderated.”
23. ELECTRONIC COMMUNICATIONS
The consumer expressly accepts that exchanges with the seller are carried out mainly electronically (e-mail). These communications have, between the parties, the same evidential value as postal letters.
24. RETENTION OF TITLE
The work remains the property of the artist until full payment of the price.
25. INTELLECTUAL PROPERTY
The purchase of the work does not grant the buyer any reproduction or exploitation rights. Copyright and moral rights remain the exclusive property of the artist.
26. APPLICABLE LAW AND LANGUAGE OF THE CONTRACT
These General Terms and Conditions of Sale are governed by French law. They are written in French. In the event of translation, only the French version will be binding between the parties.
Any dispute relating to their formation, validity, interpretation or execution will, in the absence of an amicable resolution, fall under the exclusive jurisdiction of the territorially competent French courts, even in the event of multiple defendants or a third-party claim.
